The Lasting Power of Attorney (LPA)

The LPA is a legal document which allows a person who is at least 21 years of age (‘donor‘), to voluntarily appoint one or more persons (‘donee(s)‘) to make decisions and act on his behalf should he lose mental capacity one day.

The LPA is a legal document which allows a person who is at least 21 years of age (‘donor‘), to voluntarily appoint one or more persons (‘donee(s)‘) to make decisions and act on his behalf should he lose mental capacity one day.

A donee can be appointed to act in the two broad areas of personal welfare and property & affairs matters.

Your donee(s) will be given powers (i.e. Personal Welfare and/or Property and Affairs) to make decisions on your behalf when you lack mental capacity, or when they have reason to believe1 you lack such capacity.

Please choose wisely and appoint donee(s) you know well and whom you can trust.

  • Early preparations to protect your interests should one become vulnerable one day.
  • Enables you to make a personal, considered choice of a trusted proxy decision maker, who is reliable and competent to act in his or her best interests.
  • Alleviates the stress and difficulties faced by loved ones who need to apply for a Deputyship order, if you lose mental capacity without an LPA in place.

Examples of powers that your donee(s) will have in relation to your Personal Welfare and/or Property and Affairs are:

Personal Welfare

  • Where you should live
  • Day to day care decisions (what to wear and eat)
  • Handling your letters / mail
  • Who you may have contact with
  • Healthcare and medical treatment decisions

Property and Affairs

  • Buying, selling, renting and mortgaging your property
  • Operating your bank accounts
  • Managing your CPF monies
  • Paying household expenses
  • Purchasing any equipment you may need

Choosing your Donee(s)

Choose your donee(s) wisely

  • 21 years old and above
  • Someone you trust to make decisions on your behalf, in your best interests

Choose what decision powers to grant your donee(s)

  • Personal welfare
  • Property and affairs
  • Both

If you have more than 1 donee, decide if they are to act

  • Jointly – donees have to act together, cannot act separately.
  • Jointly & severally – donees can make decisions together or separately. Both types of decisions are valid.

How to make a Lasting Power of Attorney (LPA)

3 key steps

Step 1:

Donor completes the LPA online via OPGO (OPG Online)

  • Access OPGO via an Internet-enabled device
  • Login using Singpass to verify personal details’
  • Fill in Donee(s) details and powers to be granted to Donee(s)

Step 2:

Donee(s) accepts appointment

  • Access OPGO using an Internet-enabled device.
  • Login using Singpass to confirm personal details.
  • Accept appointment as a Donee in LPA

Step 3:

Certificate Issuer (CI) certifies and witnesses Donor’s signing of LPA

  • Donor visits a CI (an accredited medical practitioner, practising lawyer, or psychiatrist) to have the LPA certified.
  • Donor must bring along the mobile phone stated in the LPA, with the Singpass app installed and the digital signing enabled

Please note that the Lasting Power of Attorney (LPA) should be made when you are well and have full mental capacity.

During the consultation, if the Donor is found to have any degree of loss of mental capacity, the clinic reserves the right to immediately reject the certification and to refer the Donor for further mental evaluation.

Where to apply for LPA

You can apply for the LPA online here – https://opg-eservice.msf.gov.sg/.

At the same time, you can also choose to sign an Advance Medical Directive (AMD). The AMD is a legal document that you sign in advance to inform the doctor treating you (in the event you become terminally ill and unconscious) that you do not want any extraordinary life-sustaining treatment to be used to prolong your life. The cost of making an AMD is $32.70 per form.
